Who Should File a Claim
Now that you have an understanding of the history of B&W, let’s explore who is eligible to file a claim with the Trust.
The Trust is designed to provide compensation for those who have an injury as a result of exposure to asbestos-containing products that were manufactured by B&W. The Trust also protects those who are not presently injured but may develop an asbestos-related disease in the future due to exposure.
If you are unsure of your eligibility, you may still file a claim with the Trust. Your claim will be reviewed and we will determine your eligibility.
Choosing Claim Options
You must choose between two types of claim filing processes: Expedited or Individual Review. The Expedited Review option is a much shorter process resulting in a quicker response for payment. The Individual Review option undergoes a more detailed review and the value of the claims is determined by the information provided.
Expedited Review
- Shorter process resulting in quicker response;
- Processed first, in order of first received by the Trust;
- Single, fixed payment;
- All Expedited Review claims of the same disease catergory receive the same payment amount;
- All Expedited Review claims are evaluated identically.
Individual Review
- Undergoes a more detailed review;
- Receives Individualized evaluation;
- Could result in a higher or lower payment than the Expedited Review
- Processed after Expedited Review claims received on the same date.
