Modification of B&W Claim Form – Mailing
The B&W Trustees, with the consent of the Trust Advisory Committee (TAC) and the Future Claims Representative, have modified the current Claim Form and revised the Significant Occupational Exposure (SOE) policy. Specifically, Part 3, Question 5 “Circumstances of Exposure” has been expanded. Using the new Claim Form, you will now need to place a check mark next to the statement that best describes how the claimant was exposed to asbestos or asbestos-containing products.
All claims, including those previously filed with the Trust, must be updated using this new Claim Form. In order to expedite the process of complying with this new policy, enclosed in the mailing is an Excel spreadsheet of all claims submitted by your firm as of January 25, 2007. In addition to the exposure information previously submitted, you must update these claims to accurately answer Part 3, Question 5. Claims cannot be fully processed until this information has been completed and returned to the Trust.
To facilitate this process, we strongly recommend that you use the Excel spreadsheet to indicate the appropriate circumstance of exposure for each claim.
If choosing the fifth checkbox, “None of the above”, you must detail the nature of the claimant’s exposure to asbestos or asbestos–containing products. Simply restating the text from one of the other four descriptions of exposure will not be accepted. Each statement regarding “Circumstances of Exposure” should describe that individual’s nature of exposure and not be the same statement reiterated across industries and occupations, as this is considered “boilerplate” language and is not acceptable.
Please return the completed spreadsheet by February 16, 2007 utilizing one of the following options:

Failure to update your claims that require SOE, e.g., Disease Levels III, IV, V or VII, with this additional information will result in a deficiency being placed on these claims and no further processing can occur until this information is provided.
